Background
The goals and principles of making biodiversity, environmental and natural resources data openly and universally available have been defined in the BERDS System Objectives document. [see BERDS Policies for more details.]
BERDS data sharing takes place within a framework of due acknowledge of data ownership, privacy of sensitive data and promotion of responsible data usage practices by all parties involved.
Therefore, before using data or documentation available through BERDS and its affiliated networks, you MUST agree with the following:
1. DATA USE AGREEMENT
- The quality and completeness of data cannot be guaranteed. Users employ these data at their own risk.
- Users shall respect restrictions of access to sensitive data.
- In order to make attribution of use for owners of the data possible, the identifier of ownership of data must be retained with every data record.
- Users must publicly acknowledge, in conjunction with the use of the data, the data providers whose data they have used. Data providers may require additional attribution of specific collections within their institution.
- Users must comply with additional terms and conditions of use set by the data provider. Where these exist they will be available through the metadata associated with the data.
2. PUBLIC DOMAIN
The contributing author expressly states that this file is being placed in the public domain or is "Freeware" and may be freely used and redistributed, is provided "AS-IS" without
warranty of any kind and there is no technical support provided.
3. METADATA
If a GIS Layer, this file may contain CSDGM (FGDC)- compliant metadata as .htm and .met files for use with web browsers and ArcGIS, respectively. Use and distribution of such a dataset must retain those metadata at all times. You may distribute this dataset only as it was downloaded, in WinZip archival format and with its accompanying metadata.
5. COPYRIGHT The File(s) are owned by the Author and are protected by United States copyright laws and/or applicable national or international laws, treaties, and/or conventions.
The following Author attribution information must be given in comment form in the File(s), in an "Help-About" dialog box, in a supporting digital "Read Me" file,
and/or provided in digital form for on-line documentation, and at the beginning or end acknowledgment page of any hard-copy documentation:
"Portions of this work include intellectual property of [Insert Name of Author] and are used herein with permission. Copyright (C) [Insert year(s)] [Insert Name of Author]. All rights reserved."
6. DISCLAIMER OF WARRANTY End User expressly acknowledges that the File(s) are unsupported GIS layers, documents, files, and /or scripts and that no technical support shall be provided to End User by the Author.
THE FILE(S) ARE PROVIDED "AS-IS," WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, BY STATUTE OR OTHERWISE, INCLUDING, BUT NOT LIMITED TO ALL IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. THE AUTHOR DOES NOT WARRANT THAT THE OPERATION OF THE SCRIPTS/FILES/DATA/ETC SHALL BE UNINTERRUPTED OR ERROR FREE. END USER BEARS ALL RISK AS TO THE QUALITY AND PERFORMANCE OF THE DOWNLOADED FILES.
7. GOVERNING LAW This license is governed by the laws of host country or that of the Author's country of residence without reference to conflict of laws principles.
8. ENTIRE AGREEMENT The parties agree that this Agreement constitutes the sole and entire agreement of the parties as to the matter set forth herein and supersedes any previous agreements, understandings, and arrangements between the parties relating hereto when End User assents to be bound by these terms and conditions by clicking the "Accept" button below.
